1. Acceptance of Terms

By accessing and using MandarinLab ("the Service"), operated by MandarinLab ("MandarinLab", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

MandarinLab provides AI-powered tools for creating educational materials for Mandarin Chinese learning, including worksheet generation, exercise templates, and content assistance.

3. User Accounts

You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account. You must be at least 16 years old to create an account.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose;
  • Attempt to gain unauthorized access to the Service or its systems;
  • Use automated tools (bots, scrapers) to access the Service without permission;
  • Exceed the rate limits or usage quotas of the Service;
  • Upload or transmit content that infringes intellectual property rights;
  • Use the Service to generate harmful, misleading, or inappropriate educational content;
  • Use the Service to generate, request, or distribute NSFW, sexually explicit, pornographic, or adult content of any kind;
  • Use the AI image generation features (e.g., picture books) to create violent, hateful, discriminatory, or otherwise objectionable imagery;
  • Share your account credentials with third parties.

5. Intellectual Property

You retain ownership of the content you create using our Service. By using the Service, you grant us a non-exclusive, worldwide license to process, store, and display your content solely as necessary to provide the Service.

6. AI-Generated Content & Content Safety

Our Service includes features powered by Artificial Intelligence, including AI-generated images (e.g., picture books and illustrations). You acknowledge and agree that:

  • AI-generated content may contain inaccuracies and should be reviewed before use;
  • We do not guarantee the accuracy, completeness, or appropriateness of AI-generated content;
  • You are solely responsible for reviewing and verifying all AI-generated content before distributing it;
  • We do not claim ownership of AI-generated content;
  • You must not use the Service to generate NSFW, sexually explicit, adult, violent, hateful, or otherwise prohibited content. This applies to all AI features, including but not limited to text generation, image generation, and picture book creation;
  • We reserve the right to implement content moderation filters to prevent the generation of prohibited content;
  • Violation of this content policy may result in immediate account termination without refund.

7. Subscription and Payment

Payments are processed by Armitage Labs OÜ, operating as Creem ("Creem"), our Merchant of Record, who handles billing, taxes, and refunds on behalf of MandarinLab. By purchasing a subscription, you agree to Creem's Terms of Service and Privacy Policy.

Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel your subscription at any time through your account dashboard. For refund eligibility, please refer to our Refund Policy.

In addition to subscriptions, we offer one-time purchases such as image credit packs. These are non-refundable once the credits have been used.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MANDARINLAB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Service Availability

We strive to provide uninterrupted access to our Service but do not guarantee 100% uptime. We may perform scheduled maintenance from time to time and will attempt to provide advance notice.

10. Termination

We reserve the right to terminate or suspend access to our Service immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time through the account settings.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page. Your continued use of the Service after such changes constitutes acceptance.
